If you do not agree with any part of these terms, please do not use this Site or engage our services. These terms apply to all visitors, users, and customers.
OT Ontario Masonry is a Masonry Contractor providing residential and commercial masonry services in Ontario, CA and the surrounding Inland Empire area. Our services include but are not limited to foundation repair, chimney repair, tuckpointing, brick and stone masonry, retaining walls, driveway pavers, fireplace installation, and masonry restoration.
All services are provided by or under the supervision of licensed contractors. We reserve the right to decline or discontinue any service at our discretion. The information provided on this Site is for general informational purposes and does not constitute a binding service agreement or guarantee of availability.
Estimates provided verbally, electronically, or in writing are good-faith assessments based on information available at the time and are not binding contracts. Final pricing is determined by a written proposal signed by both parties. Actual costs may vary if site conditions, project scope, or material requirements differ from what was assessed at the time of the estimate.
Any change orders - additions or modifications to the agreed scope of work - must be documented and agreed to in writing before additional work proceeds. Verbal authorizations to expand scope do not constitute binding agreements.
Scheduled appointments and project start dates are subject to weather conditions, material availability, and other factors outside our control. We will make reasonable efforts to notify you of any delays or rescheduling needs as soon as possible.
If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible. Cancellations made with less than 24 hours notice may result in a cancellation fee if materials or crew time have already been committed to your project. The specific terms for any cancellation fee will be stated in your written service agreement.
We reserve the right to reschedule or cancel any appointment due to weather, safety concerns, or other circumstances outside our reasonable control, without liability to you.
Payment terms are specified in your written service agreement. In general, a deposit may be required before work begins, with the balance due upon completion of the project unless otherwise agreed in writing. For larger projects, progress payments tied to completion milestones may be established in the service agreement.
Accepted payment methods will be communicated at the time of your service agreement. Invoices not paid by the due date may be subject to a late fee as specified in your agreement. We reserve the right to suspend or stop work on any project where payment obligations are not met.
In the event that collection efforts are necessary, you agree to be responsible for all reasonable costs incurred in collecting any overdue amounts, including reasonable legal fees.
Where a written warranty is provided with a specific service, the terms of that written warranty govern. Verbal representations about warranty duration or coverage do not constitute binding warranty terms.
Warranties, where provided, do not cover damage caused by events outside our control, including but not limited to earthquakes, flooding, soil movement beyond normal seasonal variation, improper use, alterations by third parties, or failure by the property owner to maintain conditions reasonably necessary to preserve the repair.
The information and content on this Site are provided "as is" without any warranty of any kind, express or implied, including warranties of accuracy, completeness, or fitness for a particular purpose.
To the fullest extent permitted by applicable law, OT Ontario Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this Site or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid us for the specific service giving rise to the claim. Some jurisdictions do not allow the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.
We prefer to resolve any disagreements directly. If you have a concern about work performed or any other matter, please contact us first so we have the opportunity to address it. Most issues can be resolved quickly through direct communication.
If a dispute cannot be resolved informally, the parties agree to attempt resolution through mediation before pursuing litigation. Any unresolved dispute shall be subject to binding arbitration in Ontario, CA, in accordance with applicable arbitration rules, unless both parties agree in writing to an alternative process.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these terms shall be brought exclusively in a court of competent jurisdiction in San Bernardino County, California.
You may use this Site for lawful purposes only. You agree not to use the Site to transmit any material that is unlawful, harmful, defamatory, or otherwise objectionable. You agree not to attempt to gain unauthorized access to any portion of the Site or any systems connected to it.
We reserve the right to modify, suspend, or discontinue any part of this Site at any time without notice or liability to you.
